This Privacy Policy relates to how EQ Consultants (‘EQ Consultants’, ‘our’, ‘us’ or ‘we’) collects and handles personal information in accordance with Privacy Act 1993 and the privacy principles set out in that Act.

For the purpose of this Privacy Policy, the term ‘personal information’ means information or an opinion, whether true or false, recorded in a material form or not, about an identified individual or reasonably identifiable individual.

This Privacy Policy explains how EQ Consultants collects, uses, discloses and otherwise handles personal information. It also explains the process of how you may request access to, and correction of, personal information we hold about you or complain about any suspected breach of privacy.

We will only collect your personal information where it is reasonably necessary in order for us to carry out one or more of our services.

By using our services or providing your personal information to us, you consent to our collection, storage, use and disclosure of your personal information in accordance with this Privacy Policy.

We may amend the terms of this Privacy Policy from time to time and will notify you of any changes by posting an updated version on our website. It is your responsibility to check this Privacy Policy periodically for changes.

Your continued use of our services following notification of any changes to this Privacy Policy constitutes acceptance of those changes. If you do not agree with any aspect of the updated Privacy Policy, you must immediately cease all use of our services.

What information may we collect?

EQ Consultants collects and holds personal information. This information may include:

Personal details, e.g. your name, CV content or information provided in an application form
Demographic data, e.g. your date of birth, nationality
Contact details, e.g. email address
Information gathered from authorised third parties, e.g. reference checks
Information that you have made public, e.g. via LinkedIn

How we use personal information?

EQ Consultants will use the personal information it collects and holds primarily for the following reasons:

Provide our services, i.e. HR Consulting, Recruitment, Training & Development
Targeted marketing communications to existing and prospective clients, network and service subscribers
To help us improve our benefits and services

EQ Consultants collects this information in various ways, including job application forms, CV/resumes, LinkedIn, Facebook job applications, subscriber applications, registrations, enrolments and renewal forms and terms of business.

This information may be in the form of email, telephone, letters, registrations to events, webinars, mentoring, training, and where applicable, via surveys.

EQ Consultants may also collect and handle personal information for other reasons explained at the time of collection, or which are required or authorised by, or under law, as appropriate, including privacy legislation in Australia and New Zealand.

Marketing and Communications

By subscribing to emails and/or text communications, or otherwise providing your email address and/or mobile number, you consent to receiving emails and/or texts (as the case may be) which promote and market our products and services, or the products and services of others, from time to time.

EQ Consultants provides the option for you to opt-out of all forms of communication that we have with you in receiving marketing material, including letters and/or email, by writing to EQ Consultants, PO Box 22 041, Christchurch 8142 and/or using the unsubscribe function included in electronic communications.

Disclosure of Personal Information

EQ Consultants will not disclose your personal information without your consent with third parties unless this is necessary to the performance of our services or a directly related purpose or required by law. This may include disclosure of personal information to businesses/organisations we're recruiting on behalf of, printing companies, IT services, and event and conference organisers.

EQ Consultants will take the appropriate steps to ensure that any third-party individuals, contractors or business:

are made aware that they are authorised only to use personal information for the purpose it has been provided to the third party to deliver the product and/or services, as is required by EQ Consultants, or in the case of an event or conference, for the facilitator to perform their role at that event; and
the third-party individual, contractor or business complies with the Privacy Act 1993 when they handle your personal information.

Security of Personal Information

EQ Consultants take reasonable steps to protect personal information held from misuse and loss and from unauthorised access, modification or disclosure. This includes secure lockable cabinets, secure office access, the use of firewalls, anti-virus software, the username (login) and password protection. It is also a condition of employment that all EQ Consultants’ employees and contractors maintain the confidentiality of all personal information.

Where EQ Consultants no longer requires your personal information for a permitted purpose under the Privacy Act, they will take reasonable steps to destroy it.

Access, Correction & Deletion of Personal Information

EQ Consultants endeavour to ensure that the personal information it holds is accurate, complete and up to date. You have the right to request access to the personal information we have collected and hold about you. Subject to any lawful reason not to, we will give you access to the personal information we hold for you and allow you to correct any information that is incorrect.

To ensure that we do not disclose personal information to the wrong person, we will ask you to verify your identity. If you are unable to verify your identity, we may not be able to give you access to your personal information.

EQ Consultants will take all reasonable steps to correct the personal information we have collected and hold about you if we are satisfied that it is inaccurate, out-of-date, incomplete, irrelevant or misleading. This extends to third parties that we have provided your personal information to, unless it is impracticable or unlawful to do so.

Upon your request, we will consider deleting all personal information from our records. Subject to any lawful requirement not to, we will do our utmost to delete or de-identify your personal information.

We may refuse access or deletion if it would interfere with the privacy rights of other persons or if it breaches any confidentiality that attaches to that information. If, for any reason, we do not allow you access to your personal information or refuse to correct the information we have collected and hold for you, or refuse to delete your personal information on request, we will inform you as to why. You may, of course, request that we include a note of your request to correct any personal information alongside the information that you believe to be inaccurate.

We take all privacy concerns seriously and will endeavour to acknowledge your request within two business days and respond to your complaint, in writing, within 30 days of receipt. If the personal information you seek access to has been archived and is held offsite in secure storage, you should also anticipate that it may take longer for us to process your application for access so that we can retrieve the information from storage and review it in order to determine which information may be provided.

Please note: EQ Consultants might impose a moderate administration charge for the cost of accessing any personal information held offsite in a secure storage facility.
